Terms of Service

These Terms of Service ("Terms") govern your access to and use of the myprivacyback service (the "Service") provided by MyPrivacyBack ("we", "us", "our"). By creating an account, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service submits data-deletion and opt-out requests to data brokers, people-search sites, and similar third parties on behalf of the household members you register. We use jurisdiction-appropriate legal frameworks (CCPA, GDPR Art. 17, UK GDPR, and others) to make those requests. The Service re-submits requests on a recurring 60-day cycle for as long as your subscription is active.
The Service does not guarantee that any specific data broker will comply with a removal request, or that your personal information will not reappear on the internet through sources outside our coverage. Data brokers may legally refuse requests that fall outside applicable law's scope (e.g. requests from non-residents to CCPA-only brokers).
2. Eligibility and authority
You must be at least 18 years old to create an account. By adding a household member to your account, you represent that you have legal authority to act on their behalf in submitting deletion requests — for example, you are the data subject, you are the parent or legal guardian of a minor, or you have written consent from the adult member.
We may, at our discretion, require you to provide written authorization (e.g. an authorized-agent designation under CCPA) before submitting requests for certain household members.
3. Account and security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@myprivacyback.com if you suspect unauthorized access.
4. Acceptable use
You agree not to:
- Submit information about anyone you do not have authority to represent
- Use the Service to harass, defame, or impersonate any person
- Reverse-engineer, scrape, or attempt to extract our broker registry or templates
- Use the Service to send unsolicited communications or for any unlawful purpose
- Interfere with the Service's operation or security
- Resell, white-label, or sublicense the Service without our written permission
We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.
5. Subscriptions, billing, and refunds
The Service is offered on a subscription basis. Prices are listed on the pricing page. By subscribing you authorize us (and our payment processor) to charge your payment method on a recurring basis until you cancel.
30-day money-back guarantee. If you are not satisfied within the first 30 days of your initial subscription, email support@myprivacyback.com and we will refund the full amount paid. After 30 days, payments are non-refundable except where required by law.
Cancellation. You may cancel at any time from your dashboard. Cancellation takes effect at the end of your current billing period. We will continue sending removal requests through the period you've paid for.
Price changes. We may change our prices. Existing subscribers will be notified by email at least 30 days before a price change takes effect on their next renewal.
6. Closed beta
The Service is currently offered as a closed beta accessible by invitation only. During the beta period, features may change without notice, and we may temporarily restrict or extend access. Your subscription terms and money-back guarantee continue to apply.
7. Intellectual property
The Service, including our broker registry, request templates, software, and brand, is owned by MyPrivacyBack and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal use during your subscription.
You retain ownership of the personal information you provide. By submitting it, you grant us the limited rights necessary to process it as described in our Privacy Policy and Data Processing Addendum.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that (a) every data broker will comply with our requests, (b) your personal information will not reappear elsewhere on the internet, (c) the Service will be uninterrupted or error-free, or (d) any specific result will be achieved. The Service is a best-effort tool for exercising legal rights you already have under data protection law.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYPRIVACYBACK AND ITS AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR REPUTATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED EUROS (€100).
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for gross negligence, willful misconduct, or for death or personal injury caused by our negligence.
10. Indemnification
You agree to indemnify and hold harmless MyPrivacyBack from any claims, damages, or expenses arising from (a) your breach of these Terms, (b) your submission of information about a person you do not have authority to represent, or (c) your misuse of the Service.
11. Termination
We may suspend or terminate your account if you violate these Terms, if your payment fails and is not cured, or if continued service exposes us to legal risk. On termination, your subscription ends and we delete your account data within 30 days as described in our Privacy Policy.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email to active subscribers at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
13. Governing law and disputes
These Terms are governed by the laws of France, excluding its conflict-of-laws rules. Any dispute will be resolved in the competent courts of Paris, France, unless you are a consumer entitled to invoke a different mandatory venue under local law.
EU consumers may also use the European Commission's online dispute-resolution platform: ec.europa.eu/consumers/odr.
